Eco-Friendly Party™ LLC ("we") provides certain services (described below) on or through our website, www.ecofriendlyparty.com, by using our site, you agree to the following terms and conditions (the "Terms of Service") These Terms of Service comprise the entire agreement between you and Eco-Friendly Party™ and supersede all prior agreements between the parties regarding the subject matter contained herein. In addition, when using particular services on or through the Site, you shall be subject to any posted policies and guidelines applicable to such services, including any terms or condition applicable to services provided in conjunction with any of our content and service partners. All such rules and guidelines are hereby incorporated by reference into these Terms of Service. If you do not understand or agree with these Terms of Service, please do not use the Site or the Eco Friendly Service (as define below) and do not register to be a member of the Site. Eligibility

The Use of the Eco-Friendly Party™ Service is void where prohibited. By using this Site, you represent and warrant that you have the right, authority, and capacity to enter into this agreement and to abide by all the terms and conditions of these Terms of Service. You must be an individual of 13 years of age or older to register or use the Site. We strongly encourage parents and guardians to supervise the activity of all children under the age of 18 using the internet.

It is Eco-Friendly Party™'s policy to respect the privacy of its users. Eco Friendly's policies with regard to personally identifiable information it collects from you, what information third parties affiliated with Eco-Friendly Party™ collect from you, and how that information is used is governed by the Eco-Friendly Party™ Privacy Policy which you can access here

Registration

You are required to register with Eco-Friendly Party™ to use all their services, submit a party, send a friendly invitations to a private event (see private event below) post a public event on Eco-Friendly Party™, send your wish list, access your inbox, view your calendar, view and edit your info page and upload pictures. In order to register with Eco-Friendly Party™ you must supply a valid email address, which will be used as a unique identifier for your account, and your name, zip code and a password.

You are solely responsible for maintaining the confidentiality of your password and account, and agree not to transfer your email address or password, or lend or otherwise transfer your use of or access to the Eco-Friendly Party™ Service, to any third party. You are also solely responsible for any and all activities that occur under your account. You may change your password or any other account information, at any time by following our instructions. We are not liable for any loss or damage arising from your failure to comply with any of the forgoing obligations.

In order to use Eco-Friendly Party™ services you agree to provide certain current, complete and accurate information and maintain update the information as required keeping it current, complete and accurate. If any information is inaccurate, Eco-Friendly Party™ reserves the right to terminate your account immediately and the right to use Eco-Friendly Party™ services.

  • Eco-Friendly Party™ lets you to choose or create and send invitations to your friends create and send a wish list for your gifts.
  • Eco-Friendly Party™ gives you the choice to support your cause and ask for donations instead of gifts.
  • Eco-Friendly Party™ will accept the donations, divide them in the way the host has decided and send checks to the Non Profit selected and to the host.
  • Eco-Friendly Party™ gives you a Cash gift choice, where you can ask for cash instead of gifts after the day of the party a check will be sent to the host.
  • Eco-Friendly Party™ links you with providers of eco friendly gifts. Derive in a relation between you and a third Party site via Affiliate and Drop ship programs.
  • Eco-Friendly Party™ offers you a guide to recycling your party trash, that can not be complete, reliable, current, or error free.
  • Share your pictures allows you to share pictures from your party with other guests and print them. You and the guest you want to share the pictures may register to Eco-Friendly Party™ web page to access to them.

All contend and services shall automatically be deemed to be part of the Eco-Friendly Party™ Service when is available trough the Site.

A) Advertisers or third party vendors

Third parties other than Eco-Friendly Party™ website, provide services, advertise, or sell products on this Site. Your dealings with advertisers and third party vendors found on or trough the links of Eco-Friendly Party™, including your participation in promotions, the purchase of goods and any terms, conditions, warranties or representations associated with such activities, are solely between you and the third party. B) Your donations or charitable contributions to non profits

Eco-Friendly Party™ provides the opportunity to make donations and support different causes. This charitable contribution is going to be made at the party host. When a person decides to ask for support a cause and donate to this specific cause as gifts Eco-Friendly Party™ is going to receive the payments trough credit cards. The guest will have the option to decide how much would like to contribute to the specific cause.

Once the payment is made there is no Refund Policy. All payments made by invited guests are non-refundable.

After all the invited guests have made their payment toward the party, Eco-Friendly Party™ will calculate the total funds contributed toward the birthday party. Eco-Friendly Party™ will deduct 5% from the total amount accumulated to cover our Gateway and payment process services. Eco Friendly is going to divide the money based on how much the person has decided to donate to its selected cause. Donations will be made to the designated recipient within 20 working days of the party close date.

c) Your cash gifts

Eco-Friendly Party™ provides the opportunity get at receive Cash Gifts.

Your payment terms: When a person decides to ask for a cash gift for a specific motive, Eco-Friendly Party™ is going to receive the payments from guest trough credit cards.

Once the payment is made, there is no Refund Policy. All payments made by invited guests are non-refundable. After all the invited guests have made their payment toward the party, Eco-Friendly Party™ will calculate the total funds contributed toward the birthday party. Eco-Friendly Party™ will deduct 5%% from the total amount accumulated to cover our Gateway and payment process services. Within 10 working days after the party date, Eco-Friendly Party™ is going to send the money to the host or celebrated person.

d) Transactions with Organizations or Individuals

Eco-Friendly Party™ shall not be liable for your interactions with any organizations and/or individuals found on or through the Eco Friendly Service. This includes but is not limited to, payment and delivery of goods and services, and any other terms, conditions, warranties or representations associated with such dealings. These dealings are solely between you and such organizations and/or individuals. Eco-Friendly Party™ reserves the right, but has no obligation to become involved in or monitor disputes between you and organizations and/or individuals found on or trough the Eco-Friendly Party™ Service.

User Friendly Conduct

Eco-Friendly Party™ reserves the right, but does not assume the responsibility, to monitor or review your conduct on www.ecofriendlyparty.com. Your use of our friendly services is subject to all applicable local, state, national or international laws and regulations.

In using Eco-Friendly Party™ services you agree not to:

Post, transmit, or otherwise make available, trough or in connection with Eco-Friendly Party™:

  • Anything that is or may be (a) unlawful, threatening, harassing, degrading, abusive, hateful or intimidating; (b) defamatory; libelous or invasive of another’s privacy; (c) fraudulent or tortuous; (d) vulgar, obscene, indecent, sexually explicit, pornographic or otherwise objectionable; or (e) protected by copyright, trademark, trade secret, right to publicity or other proprietary right without the express prior consent of the owner of such right.
  • o Any material that would give rise to criminal or civil liability; that encourages conduct that constitutes a criminal offense including prostitution; or that encourages or provides instructional information about illegal activities.

  • Attempt to gain unauthorized access to Eco-Friendly Party™, other accounts, computer systems or networks connected to Eco-Friendly Party™, through password mining or any other means.
  • Use any robot, spider, site search/retrieval application or other manual or automatic device to retrieve, index, in any way gather Content or Materials from Eco-Friendly Party™ or reproduce or circumvent the navigational structure or presentation of Eco-Friendly Party™.
  • Engage in any other conduct which in Eco Friendly's Party sole discretion, is considered inappropriate, unauthorized or objectionable.

No Spamming

You agree not use any feature of Eco-Friendly Party™ for chain letters, junk mail, or "Spamming nor make any use of the distribution lists in a manner involving any person who has not given specific permission to be included in such a process. An e-mail advertisement which is (a) addressed to a recipient with whom you do not have an exiting business or personal relationship and (b) is not sent at the request of or with the express consent of the recipient to receive such communications from you spam is strictly prohibited by Eco-Friendly Party™. If you use any feature of Eco-Friendly Party™ for the purpose of sending Spam, you right to use Eco-Friendly Party™ immediately terminates and Eco-Friendly Party™ reserves the right to seek appropriate legal resource, as necessary. You agree that Eco-Friendly Party™ may, at its sole discretion, immediately remove any communications that it reasonably believes constitutes "Spamming, including removal of any contact information related thereto. If you believe that other users are using Eco-Friendly Party™ for Spam, please notify Eco-Friendly Party™ using the Feedback/ Support link at the bottom of our page, or by emailing Eco-Friendly Party™ at support@ecofriendlyparty.com. Please note that by posting a public event you are consenting to receive, and authorizing Eco-Friendly Party™ to forward to you, emails from their users. Such messages are not included in the above definition of Spam.

Limitation of liability

Your use of Eco-Friendly Party™ web site, its services and, attendance at any Eco-Friendly Party™ related event is at your own risk and you specifically release Eco-Friendly Party™ LLC and its members of and from any and all liability, damages and claims arising from the use of this website and attendance ant an Eco-Friendly Party™ related event.
